("Jetkite", "we", "us", "our"), a private limited company (besloten vennootschap) incorporated under the laws of the Netherlands, registered with the Dutch Chamber of Commerce (Kamer van Koophandel) under number 94894744, having its registered office at Stadhuisplein 10, 1.C.06, 5611 EM Eindhoven, the Netherlands, collects, uses, shares, and protects information about you when you use our mobile applications and websites, including https://jetkite.nl (collectively, the "Service").
Jetkite B.V. is the data controller (verwerkingsverantwoordelijke) responsible for the processing of your personal data within the meaning of Regulation (EU) 2016/679 (the "General Data Protection Regulation" or "GDPR") and the Dutch Implementation Act of the GDPR (Uitvoeringswet Algemene verordening gegevensbescherming, "UAVG").
We are committed to protecting your privacy. By accessing or using our Service, you agree to the collection and use of information in accordance with this policy. This Privacy Policy should be read in conjunction with our Terms of Use.
2. Information We Collect
We collect information in a few different ways to provide and improve our Service to you.
2.1. Information You Provide Directly
Account Information: When you register for an account, we collect information such as your name, email address, and password (which is hashed).
User Content: We collect the information and content you create, upload, or post to the Service. This includes your preferences, settings, and any text, images, or prompts you enter into our features, including the Artificial Intelligence (AI) Features.
Communications: If you contact us for support, we may receive your name, email address, the contents of your message, and any attachments.
2.2. Information We Collect Automatically
Usage & Log Data: We automatically collect information about your interactions with our Service. This may include your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, access times, and other diagnostic data.
Cookies and Tracking Technologies: We use cookies, pixels, and similar tracking technologies to recognize your device, store preferences, analyze traffic, and measure the effectiveness of our content and ads. Non-essential cookies and similar technologies are only set after we obtain your consent in accordance with Article 11.7a of the Dutch Telecommunications Act (Telecommunicatiewet) and the EU ePrivacy Directive. We may allow third parties (such as Google Analytics or the Meta SDK) to use these technologies subject to your consent.
Advertising Data: When ads are shown in our apps, advertising partners may receive
device identifiers (such as GAID or IDFA), IP address, coarse location, app activity,
and information about your interactions with ads. No content you create in our apps
(such as chat messages, homework uploads, or images) is shared with advertising partners.
2.3. Information From Third Parties
Third-Party Authentication: If you log in using a third-party service (like Google, Apple, or Facebook), we will receive personal information from that service, such as your name and email address, as permitted by your privacy settings on that service.
Payment Information: All in-app purchases are processed by the respective mobile platform's billing library (Google Play Billing or Apple's In-App Purchase system). We do not collect, store, or have access to your credit card details. We only receive purchase confirmations, subscription status, and transaction history from these platforms to provide you with the services or features you have purchased.
2.4. Information We Do Not Collect
We do not knowingly collect special categories of personal data within the meaning of Article 9 GDPR (such as health data, biometric data, or data revealing racial or ethnic origin) unless required for a lawful purpose and with your explicit consent. We advise you not to submit such information through our Service.
We do not share any user-generated content (such as text, images, homework, prompts, or audio) with advertising partners.
Ads are delivered only using technical data such as identifiers and device information, subject to your consent where required.
3. How We Use Your Information
We use the information we collect for various purposes:
To provide, operate, and maintain our Service.
To process transactions, manage subscriptions, and send confirmations.
To improve and personalize the Service and develop new features.
To communicate with you, send security alerts, and provide customer support.
To ensure security, prevent fraud, and protect our legal rights.
To comply with legal obligations, including under Dutch and EU law.
3.1. Legal Basis for Processing (GDPR)
We process your personal data only where we have a lawful basis to do so under Article 6 of the GDPR. The legal bases we rely on are:
Performance of a Contract (Art. 6(1)(b) GDPR): To deliver the services you have requested, such as creating and maintaining your account, processing subscriptions, and providing customer support.
Legitimate Interests (Art. 6(1)(f) GDPR): To operate, secure, debug, and improve our Service, prevent fraud, and ensure network and information security, provided such interests are not overridden by your fundamental rights and freedoms.
Legal Obligation (Art. 6(1)(c) GDPR): To comply with our legal duties under Dutch and EU law, including accounting, tax, and consumer-protection obligations.
Consent (Art. 6(1)(a) GDPR): For specific purposes where we explicitly ask for your consent, such as for non-essential cookies, personalized advertising, or certain marketing communications. You may withdraw your consent at any time without affecting the lawfulness of processing carried out before withdrawal.
4. How We Share Your Information
We do not sell your personal information. We may share your information in these limited circumstances:
With Processors / Service Providers: With third-party vendors who process personal data on our behalf under a written data-processing agreement (verwerkersovereenkomst) compliant with Article 28 GDPR, including:
Backend and Hosting: Google Firebase (Google Ireland Limited / Google LLC).
AI Features: Google (Gemini API) and other AI providers.
Analytics: Google Analytics, Meta SDK, Microsoft Clarity.
With Advertising Partners:
We may share device identifiers, IP address, coarse location data, and app usage information with third-party advertising partners to deliver ads, measure performance, and prevent fraud. Within the EU/EEA, this only takes place after we have obtained your consent.

In Case of a Business Transfer: If Jetkite is involved in a merger, acquisition, restructuring, or asset sale, your information may be transferred as part of that transaction, subject to applicable data-protection law.
With Your Consent: For any other purpose with your explicit consent.
5. Data Storage, Security, and Retention
5.1. Our Security Measures
We implement appropriate technical and organisational measures within the meaning of Article 32 GDPR to ensure a level of security appropriate to the risk, including:
Encryption: We use TLS/SSL to encrypt all data in transit. Sensitive data is also encrypted at rest.
Access Controls: System access is limited to authorised personnel on a strict least-privilege basis.
Secure Infrastructure: Our services are hosted on secure, certified cloud infrastructure within the EU/EEA where feasible.
Regular Audits: We conduct periodic security reviews and vulnerability assessments.
Breach Notification: We have procedures in place to detect and respond to personal-data breaches and, where required by Articles 33–34 GDPR, to notify the Dutch Data Protection Authority (Autoriteit Persoonsgegevens) and affected data subjects without undue delay.
However, no electronic transmission or storage method is 100% secure, and we cannot guarantee its absolute security.
5.2. Data Retention Period
We retain your personal information only for as long as necessary for the purposes set out in this policy, or as required by law (e.g., the seven-year retention period for accounting records under Article 2:10 of the Dutch Civil Code and Article 52 of the General State Taxes Act).
If your account remains inactive for twenty-four (24) months, we may anonymise or permanently delete your personal data after attempting to notify you.
6. Your Data Rights (GDPR)
As a data subject under the GDPR, you have the following rights with respect to your personal data:
Right of Access (Art. 15 GDPR): To obtain confirmation as to whether we process your personal data and, if so, to receive a copy of that data.
Right to Rectification (Art. 16 GDPR): To request the correction of inaccurate or incomplete personal data.
Right to Erasure / "Right to be Forgotten" (Art. 17 GDPR): To request the deletion of your personal data where the legal grounds for processing no longer apply.
Right to Restriction of Processing (Art. 18 GDPR): To request that we limit the processing of your data in certain circumstances.
Right to Data Portability (Art. 20 GDPR): To receive your personal data in a structured, commonly used, machine-readable format and to transmit it to another controller.
Right to Object (Art. 21 GDPR): To object to processing based on our legitimate interests, including for direct-marketing purposes.
Rights Regarding Automated Decision-Making (Art. 22 GDPR): Not to be subject to a decision based solely on automated processing that produces legal or similarly significant effects on you.
Right to Withdraw Consent: Where processing is based on consent, you may withdraw it at any time, without affecting the lawfulness of processing carried out before withdrawal.
Right to Lodge a Complaint: To file a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens, www.autoriteitpersoonsgegevens.nl) or with the supervisory authority in your EU/EEA Member State of habitual residence, place of work, or place of the alleged infringement.

We will respond without undue delay and in any event within one (1) month of receipt of your request, as required by Article 12(3) GDPR. We may extend this period by up to two (2) further months where necessary, taking into account the complexity and number of requests.
7. Data Deletion Instructions
You may request the deletion of your account and personal data at any time.
Contact us at support@jetkite.nl with the subject line "Data Deletion Request".
Provide your full name and the email address associated with your account so we can verify your identity.
We will process your request and confirm the deletion of your data within the time limits set by Article 12(3) GDPR.
8. Opt-Out Instructions
You can opt out of data collection and advertising as follows:
In-app Consent Settings: You can change your consent for analytics and personalised advertising at any time from within the app's privacy settings.
Google: Visit the Google Ads Settings page to opt out of personalised ads.
Meta (Facebook/Instagram): Visit Meta's ad preferences page to manage your ad settings.
Apple: On your iOS device, go to Settings > Privacy & Security > Apple Advertising and toggle off "Personalised Ads".
App Tracking: On your iOS device, go to Settings > Privacy & Security > Tracking and toggle off "Allow Apps to Request to Track" for our app.
Push Notifications: You can opt out of push notifications at any time by changing the settings on your device.
9. Cookies and Consent (ePrivacy)
In accordance with Article 5(3) of the EU ePrivacy Directive (2002/58/EC), Article 11.7a of the Dutch Telecommunications Act, and the GDPR, we only place non-essential cookies, SDKs, and similar technologies on your device after we have obtained your prior, freely given, specific, informed, and unambiguous consent.
Strictly necessary cookies (for example, those required to authenticate you, remember your consent choices, or maintain the security of the Service) do not require consent.
Where the GDPR and ePrivacy rules apply, we display a consent banner before any advertising-related data is collected (such as device identifiers, IP address, or ad-interaction data). You may accept, reject, or change your choices at any time. Your consent signals are passed to our advertising partners through standardised frameworks such as the IAB Transparency & Consent Framework. If you decline personalised ads, only non-personalised advertising will be shown.
10. Notice to California Residents (CCPA)
If you are a California resident, you have rights under the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), including the right to know what personal information is collected, the right to request its deletion, and the right to correct inaccurate personal information. Jetkite does not "sell" or "share" your personal information for cross-context behavioural advertising as those terms are defined under the CCPA/CPRA without your consent.
11. Privacy Considerations for AI Features
Our Service integrates generative AI from third parties such as Google (Gemini API). Please note:
Data Submitted to AI Providers: Prompts you enter are transmitted to and processed by our AI partners according to their own privacy policies. These transfers are performed under appropriate safeguards as described in Section 13.
Do Not Submit Sensitive Information: You should not enter personal, confidential, or special-category data (Article 9 GDPR) when using AI Features.
Third-Party Policies Apply: Your use of AI is also governed by the provider's terms. For Gemini, see Google's Gemini Apps Privacy Hub.
EU AI Act Compliance: Where applicable, we comply with the EU AI Act (Regulation (EU) 2024/1689), including transparency obligations regarding AI-generated content.
By using our AI Features, you acknowledge these terms.
12. Children's Privacy
Our Service is not intended for children under the age of 18, and we do not knowingly collect their personal data. Under Article 8 GDPR and Article 5 UAVG, the digital age of consent in the Netherlands is 16; however, our Service is targeted at adults only. If you are a parent or legal guardian and believe your child has provided us with personal data, please contact us immediately at support@jetkite.nl so we can remove it.
13. International Data Transfers
Your personal data is primarily processed within the European Economic Area (EEA). However, some of our service providers (in particular Google for Firebase, Gemini API, and Analytics) may transfer or process personal data in third countries, including the United States.
Where personal data is transferred outside the EEA to a country that has not been recognised by the European Commission as offering an adequate level of protection, we ensure that appropriate safeguards under Chapter V of the GDPR are in place, such as:
The European Commission's Standard Contractual Clauses (Decision (EU) 2021/914);
The EU–U.S. Data Privacy Framework for participating U.S. recipients;
Where appropriate, additional supplementary technical and organisational measures.

14. Governing Law and Jurisdiction
This Privacy Policy is governed by the laws of the Netherlands and, where applicable, directly applicable EU law. Any dispute arising out of or in connection with this Privacy Policy shall be subject to the exclusive jurisdiction of the competent court of the District Court of Oost-Brabant, location 's-Hertogenbosch (Rechtbank Oost-Brabant, locatie 's-Hertogenbosch), the Netherlands, without prejudice to any mandatory consumer-protection rules that grant you the right to bring proceedings before the courts of your habitual residence in the EU.

We may update this policy from time to time. We will notify you of any material changes by posting the new policy on this page and updating the "Last updated" date. Where required by law, we may also notify you via email or an in-app notice and obtain your renewed consent.
